The spirit of this agreement is that, while pretty much anyone can use M-MUCK as it stands, they don't have a right to it, and if someone decides to run M-MUCK, they know that it's unfinished and still being worked on, they alone are responsible for the actions of the unfinished piece of code that they chose to install.

Important Information

M-MUCK is Beta Software. In layman's terms, that means it's not finished yet. It is likely that you will come across software bugs or other potential problems, and if you take the positive action to install and/or utilise this Beta Software, you're doing it with that in mind. If you do find some bugs, please consider reporting them to me, so that I can address them in a future update.

M-MUCK is free for you to use, but the source code to M-MUCK is not available. M-MUCK is protected by copyright law and international treaties. Unauthorised duplication, examination, reverse engineering or distribution of this program, or any portion of it, may result in severe civil or criminal penalties, and will be prosecuted to the maximum extent possible under UK law.

M-MUCK and other included files are provided "as-is". Whilst efforts have been made to prevent damage your computer, this program must be considered under development and not yet complete. You are reminded that no warranties about M-MUCK have been made to you, including warranties that may be implied or inferred, such as "merchantability" or "fitness for purpose". I hereby disclaim all liability should you choose to take the positive action to install, run or otherwise utilise this software.

Put simply, I've done what I can to not break your computer, but if you choose to download and run this software, knowing that it's still being worked on and in all probability contains software bugs and other problems, it's your responsibility to take appropriate measures to secure your computer. As with any piece of software you should scan it with a virus checker before running it, and you need to keep an eye on what it's doing. If you find it's doing something unwanted, you should close it immediately. If you do find a bug or a problem, or you'd like M-MUCK to do something it doesn't do already, please go to Mantis (which, sadly, is not available right now) and open a new "issue" to tell me all about it.

M-MUCK contains a semi-automatic updater, which allows M-MUCK to connect to a remote machine, put software onto your computer, and run it. This is used by my server to serve updates to you. Effort has been made to prevent an attacker from exploiting this and replacing my update installer with a virus, but you need to be aware that it's still possible (although unlikely) for that to happen. Please check that the hard-coded website http://m-muck.tmhosting.selfip.biz:444/ is still under my control first, and if in doubt, don't use the built-in updater.

Earlier versions of M-MUCK contained Digital Rights Management software, intended to restrict use of unstable pre-beta versions to authorised users. This is still present, however it has been set to automatically validate any and all installations. It should not ask for a key - if it does, use MMUCK-FVOYM-MMMIM-TFBDA-IOMII.

If the disclaimer of warranties, including all implied warranties, is illegal in your country or territory, then you agree that the maximum damages payable by the creator of this software shall be the price you paid to purchase permission to use this software from me - which, for the avoidance of doubt, is zero. You also agree that you shall defend me and hold me harmless in the event of any legal, civil or other proceedings; that you shall pay 125% of all of my legal costs and expenses, plus the equivalent of 25 thousand euros (25000 EUR) personal expenses in United Kingdom legal tender (presently Pounds Sterling); that the proceedings shall be governed by the law of England and Wales; and that all such proceedings shall take place in Yorkshire. Further, you agree that if this agreement is not enforcable in your jurisdiction, territory or country, or that you cannot be legally bound by this agreement, you are NOT allowed to download or use the software AT ALL.

For the avoidance of doubt, if there is any inconsistency or query over any part of this document, the creator of M-MUCK is known as Tigz Mordan, and his sole opinion governs any such inconsistency or query.
